Terms and Conditions for Waste Valet Services, LLC

These Terms and Conditions (“Agreement”) govern the use of services provided by Waste Valet Services, LLC (“Company,” “we,” “our,” “us”), a limited liability company. By using or subscribing to our waste valet services (“Services”), you (“Customer,” “you,” “your”) agree to comply with and be bound by the following terms and conditions.
1. Services Provided
Waste Valet Services, LLC provides waste collection, disposal, and related services, which may include:
- Door-to-door trash pickup, disposal, and recycling.
- Collection of waste materials, including household and residential trash, recyclables, and bulk waste.
- Composting services (if applicable).
- Other services as agreed upon by the Customer and the Company.
2. Service Agreement and Duration
- Service Agreement: By signing up for our Services, you agree to enter into a binding agreement with Waste Valet Services, LLC.
- Service Duration: The service agreement begins on the date of service activation and continues until terminated by either party in accordance with these Terms. You may cancel the Services at any time with proper notice (as described in Section 7, "Termination of Service").
3. Pricing and Payment Terms
- Service Fees: Pricing for services is determined based on the type, frequency, and scope of the services requested by the Customer. A detailed pricing schedule will be provided upon request and at the time of service initiation.
- Payment Terms: Payment is due upon receipt of an invoice or in accordance with the agreed-upon payment schedule. We accept payments via credit card, debit card, checks, or other methods approved by the Company.
- Late Payment: If payment is not received by the due date, a late fee may be applied. The Company reserves the right to suspend services until full payment is made.
4. Customer Responsibilities
- Placement of Waste: The Customer is responsible for placing waste in the designated area (e.g., curbside or in front of their home) by the scheduled pickup time. Items must be in appropriate bags or containers for easy handling.
- Waste Restrictions: The Customer agrees not to place hazardous materials, hazardous waste, electronics, tires, construction debris, or any prohibited items in their waste containers. A list of prohibited items will be provided by the Company.
- Access and Conditions: The Customer must ensure that our personnel have unobstructed access to the designated trash pickup area. Failure to provide access, or if the trash is not properly placed, may result in a missed pickup or additional fees.
5. Service Schedule and Rescheduling
- Pickup Schedule: The Company will provide regular waste pickup on the days agreed upon at the time of service initiation. We will notify the Customer in advance of any changes to the pickup schedule.
- Rescheduling: If the Customer needs to reschedule a pickup, they must notify the Company at least [X] hours/days before the scheduled service date. A rescheduling fee may apply if proper notice is not provided.
- Missed Pickup: If a scheduled pickup is missed due to customer negligence (e.g., waste not placed in the correct area), the Customer may incur a missed pickup fee or may be required to wait for the next available service date.
6. Prohibited Waste and Special Instructions
- Prohibited Waste: The Customer agrees not to dispose of hazardous waste, chemicals, flammable materials, construction debris, large appliances, or other prohibited materials. The Company reserves the right to refuse service if prohibited waste is found.
- Special Instructions: If the Customer has special requirements or instructions (e.g., large item pickup, specific disposal instructions), these must be communicated to the Company at the time of service setup. Additional charges may apply for special services.
7. Termination of Service
- By Customer: The Customer may cancel or terminate the service at any time with written notice to the Company. To avoid charges for the next billing cycle, cancellation must be received at least 30 days in advance.
- By Company: Waste Valet Services, LLC reserves the right to terminate the service at any time with or without cause, particularly in cases of non-payment, failure to comply with these Terms, or if the Customer engages in conduct detrimental to the service (e.g., placing prohibited materials in waste containers).
- Refunds: If service is terminated by the Customer, the Customer may be entitled to a partial refund depending on the remaining portion of the billing cycle, as determined by the Company.
8. Liability and Indemnification
- Limitation of Liability: The Company is not responsible for any damage to property, injury, or loss caused by the improper use or handling of waste materials. The Company is not liable for any damage to trash containers or other property due to customer negligence or failure to place waste in proper containers.
- Indemnification: The Customer agrees to indemnify and hold harmless Waste Valet Services, LLC, its officers, employees, and agents, from any liability, claims, or damages arising out of the Customer's violation of these Terms or failure to comply with waste disposal instructions.
9. Privacy and Data Protection
The Company values your privacy and is committed to protecting your personal data. We collect and process your personal information in accordance with our Privacy Policy, which can be accessed on our website. By using our services, you consent to the collection and use of your personal information as outlined in the Privacy Policy.
10. Force Majeure
Waste Valet Services, LLC shall not be liable for any failure or delay in providing services due to circumstances beyond our control, including but not limited to, natural disasters, labor strikes, pandemics, government actions, or other events of force majeure.
11. Changes to Terms and Conditions
The Company reserves the right to amend or update these Terms at any time. Any changes will be posted on our website, and the updated Terms will apply to all future services. The Customer will be notified of significant changes as applicable.
12. Dispute Resolution
- Mediation: In the event of any dispute, the parties agree to resolve the matter through mediation before pursuing any legal action.
- Governing Law: These Terms shall be governed by the laws of the state of [Insert State] and any disputes will be handled in the appropriate courts within Cobb County, GA.
13. Miscellaneous
- Entire Agreement: These Terms and Conditions constitute the entire agreement between the parties and supersede any prior agreements or understandings.
